These Terms of Service ("Terms") govern your access to and use of PortWise.io and related services ("PortWise", the "Service"). By accessing or using PortWise, you agree to these Terms. If you do not agree, do not use the Service.
PortWise is an AI investment research and paper-trading advisor platform. The Service may include Advisor creation, strategy configuration, market data review, AI-assisted research, simulated trading signals, paper portfolio execution, performance dashboards, public Advisor discovery, comments, follows, favorites, subscriptions, credits, API keys, and other related tools.
PortWise is for research and paper-trading simulation only. PortWise does not provide financial, investment, tax, legal, accounting, or other professional advice.
AI outputs, market commentary, signals, rankings, simulated returns, and Advisor reviews are informational and educational only. They are not recommendations to buy, sell, hold, or trade any security, ETF, fund, derivative, crypto asset, or other financial instrument.
Paper-trading results do not represent real trading performance. They may not reflect real execution prices, liquidity, fees, slippage, taxes, availability, market impact, outages, or broker restrictions. Past performance, backtests, simulations, rankings, and public Advisor results do not guarantee future results.
You are solely responsible for your own investment decisions. You should consult qualified professionals before making financial, legal, tax, or accounting decisions.
You must be able to form a binding agreement to use PortWise. If you use PortWise on behalf of an organization, you represent that you have authority to bind that organization.
You agree to provide accurate account information and keep it current. You are responsible for maintaining the confidentiality of your account credentials, API keys, and access tokens, and for all activity under your account. Notify us promptly if you believe your account has been compromised.
You may use PortWise only in compliance with these Terms, applicable laws, and any product documentation or limits we provide.
You are responsible for:
PortWise may allow you to create private or public Advisors. When you make an Advisor public, other users may see selected information such as the Advisor name, description, creator, strategy category, risk tags, simulated performance, run status, holdings or trades where shown by the product, comments, and social activity.
Do not publish confidential information, personal data, brokerage details, private API keys, proprietary data you are not allowed to share, or content that infringes others' rights. You are responsible for content you publish and for the consequences of making an Advisor public.
We may remove, hide, moderate, or restrict public content that we believe violates these Terms, creates legal risk, misleads users, or harms the Service.
Some features may require payment, a subscription, credits, usage limits, or a specific plan. Prices, plan features, usage limits, credit amounts, and billing intervals are shown at checkout or in the product.
By purchasing a plan or credits, you authorize us and our payment providers to charge the applicable amounts, taxes, and recurring fees where applicable. Subscriptions may renew automatically unless canceled before the renewal date through the available billing controls.
Credits are a service unit for eligible PortWise features. Unless we state otherwise, credits have no cash value, are not a deposit or stored-value product, are not transferable, and may expire according to the terms shown at purchase or grant.
Payments are non-refundable except where required by law, required by the payment provider's rules, or expressly stated by PortWise. We may change prices or plan features with notice where required.
PortWise may rely on third-party AI providers, cloud providers, market data sources, payment processors, email providers, analytics tools, customer support tools, and other vendors.
Third-party market data, filings, news, prices, fundamentals, AI models, and generated content may be delayed, incomplete, inaccurate, unavailable, or subject to third-party terms. We are not responsible for third-party services, websites, data, or content.
You agree not to:
PortWise and its software, interfaces, designs, documentation, systems, and platform content are owned by PortWise or its licensors and are protected by intellectual property laws.
You retain ownership of content you submit, such as Advisor names, descriptions, prompts, comments, uploaded materials, and strategy configuration you create. You grant PortWise a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, publish, and use that content as needed to operate, provide, secure, improve, and promote the Service, including displaying public Advisors and related public content.
You must have all rights needed for content you submit. Feedback you provide may be used by PortWise without restriction or compensation.
AI outputs may be inaccurate, incomplete, outdated, or unsuitable for your circumstances. Similar or identical outputs may be generated for other users. You are responsible for evaluating outputs, checking sources, and deciding how to use them.
To the extent permitted by law and subject to these Terms, you may use outputs generated for you. This does not give you rights in PortWise's underlying models, systems, software, templates, or third-party data.
We may update, modify, suspend, limit, or discontinue parts of the Service at any time. Advisor runs, market data ingestion, AI processing, billing features, and cloud infrastructure may be delayed or unavailable due to maintenance, provider outages, usage limits, or other issues.
We may enforce limits on Advisor count, run frequency, compute usage, storage, credits, API access, public content, or other resources.
You may stop using PortWise at any time. We may suspend or terminate your access if we believe you violated these Terms, created risk for users or the Service, failed to pay amounts owed, or used the Service unlawfully.
After termination, some provisions will continue to apply, including intellectual property, disclaimers, limitations of liability, indemnity, and dispute terms.
The Service is provided "as is" and "as available." To the fullest extent permitted by law, PortWise disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
To the fullest extent permitted by law, PortWise and its affiliates, officers, employees, agents, partners, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, trading losses, investment losses, business interruption, or cost of substitute services.
To the fullest extent permitted by law, PortWise's total liability for any claim relating to the Service or these Terms will not exceed the greater of the amount you paid to PortWise for the Service in the three months before the event giving rise to the claim or USD 100.
You agree to defend, indemnify, and hold harmless PortWise and its affiliates, officers, employees, agents, partners, and licensors from claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Service, your content, your violation of these Terms, your violation of law, or your infringement of third-party rights.
Our Privacy Policy explains how we collect and use information. By using PortWise, you agree that we may process information as described in that policy.
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of PortWise after changes become effective means you accept the updated Terms.
